Terms of Service

These terms govern your use of the TenderEU website and, where applicable, the TenderEU platform (together, the “Service”). By accessing or using the Service you agree to them on behalf of yourself and any organisation you represent. If you do not agree, do not use the Service.
The service
TenderEU provides software to discover, analyse and prepare bids for EU public tenders. Every analysis, score, match, mapping, draft and document produced by the Service is a decision-support aid only. It does not constitute legal, procurement, financial, technical or professional advice, and it is not a substitute for your own review and judgement or that of qualified advisers.
AI-generated content — important disclaimer
The Service uses artificial intelligence, including large language models, to generate and transform content. You acknowledge and accept that AI is probabilistic, not deterministic. By its nature it:
- can produce output that is incorrect, incomplete, outdated, biased or fabricated (so-called “hallucinations”), including invented facts, figures, citations, clauses or requirements;
- may return different results for the same input and cannot be guaranteed to be accurate, reproducible or 100% correct;
- may misread, mistranslate or misclassify source documents, requirements, deadlines, eligibility criteria or scoring rules;
- cannot be guaranteed to identify every requirement, risk, error or omission in a tender or in your bid.
We do not and cannot warrant the accuracy, completeness, reliability or fitness for purpose of any AI-generated or AI-assisted output. You must independently verify every output before relying on it or submitting it. Any reliance you place on the Service is strictly at your own risk.
No guarantee of outcome
We do not guarantee that any tender, bid, document, declaration or submission prepared with or assisted by the Service will be accurate, complete, compliant, admissible, shortlisted, scored as predicted, or awarded. We are not responsible or liable in any way if a document is filled in incorrectly, if a requirement is missed or misinterpreted, if a deadline is missed, if a submission is rejected or excluded, or if you do not win a public tender, whether or not AI was involved. Predicted scores, fit scores and eligibility indicators are estimates only and carry no warranty.
Your responsibility
You are solely and exclusively responsible for:
- reviewing, validating, correcting and approving every output, document and figure before use or submission;
- the accuracy of the information, documents and instructions you provide;
- ensuring your bids meet all applicable laws, tender rules, formats and deadlines;
- the final content of anything you submit to a contracting authority or third party;
- maintaining the security of your account and all activity under it.
The Service assists your work; it does not replace your professional review, and final decision-making and submission remain entirely yours.
Accounts & plans
You are responsible for the accuracy of the information you provide and for all activity under your account. Plans, limits and pricing are as described on our pricing page and in your order.
Acceptable use
- Do not misuse, disrupt, or attempt to gain unauthorised access to the Service.
- Do not use the Service unlawfully or to infringe the rights of others.
- Do not resell or provide the Service to third parties except under an agreed partner or agency licence.
Your content
You retain ownership of the data and bid content you upload. You grant us the limited rights needed to process it solely to provide the Service. We do not use your confidential content to train public models. See our Privacy Policy.
Warranties disclaimer
To the maximum extent permitted by applicable law, the Service is provided “as is” and “as available” without warranties of any kind, whether express, implied or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that any output will be accurate or meet your requirements.
Limitation of liability
To the maximum extent permitted by applicable law:
- we shall not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, nor for any loss of profit, revenue, business, contracts, tenders, opportunity, goodwill, data or anticipated savings, however arising;
- we shall not be liable for any loss or damage arising from AI output, inaccuracies, hallucinations, omissions, mistranslations, incorrectly completed documents, missed requirements or deadlines, or any failure to be shortlisted or awarded a tender;
- our total aggregate liability for all claims arising out of or relating to the Service, on any basis (contract, tort including negligence, statutory or otherwise), is limited to the amounts you actually paid us for the Service in the twelve (12) months immediately preceding the event giving rise to the claim.
Nothing in these terms excludes or limits liability that cannot be excluded or limited under applicable law (such as for death or personal injury caused by negligence, or for fraud). Some jurisdictions do not allow certain exclusions; in that case the exclusions apply only to the extent permitted.
No transfer or assumption of liability
You agree that liability for your bids, submissions and procurement outcomes rests with you and cannot be transferred to, or assumed by, TenderEU. We do not act as your agent, adviser, bid writer or representative before any contracting authority, and we accept no responsibility or liability arising from your participation in any procurement.
Indemnity
You agree to indemnify and hold harmless TenderEU and its officers, employees and suppliers from and against any claims, damages, losses, liabilities and costs (including reasonable legal fees) arising out of or related to your use of the Service, the content you submit, your bids and submissions, or your breach of these terms.
Availability
We work to keep the Service available but may modify, suspend or discontinue any part of it at any time. We are not liable for any unavailability, maintenance, data loss or delay.
Governing law
These terms are governed by the laws of the jurisdiction in which TenderEU is established, and the courts of that jurisdiction have exclusive jurisdiction, without prejudice to any mandatory consumer protections available to you locally.
Changes
We may update these terms; material changes will be notified on this page. Continued use after changes constitutes acceptance.
